3.3 High-Risk Traffic

  • Tech support scams
  • Lottery, sweepstakes, or prize scams
  • IRS, tax authority, or legal threat campaigns
  • Credit card, loan, or financial service blasting without consent
  • Lead generation spam or data harvesting campaigns

3.4 Network Abuse

  • Traffic pumping or artificial inflation of call volumes
  • CLI spoofing or manipulation
  • Bypassing regulatory or carrier restrictions

4. Consent Requirements

All users must maintain verifiable proof of consent for communications, including:

  • Opt-in records (digital or written)
  • Clear agreement from recipients
  • CRM-based communication tracking

Failure to provide proof of consent may result in immediate suspension.

5. Compliance with Regulations

Users must comply with all applicable laws and regulations, including but not limited to:

  • FCC (Federal Communications Commission) rules
  • TCPA (Telephone Consumer Protection Act)
  • ITG traceback cooperation requirements
  • Local telecom and data protection laws

6. Monitoring and Enforcement

Dialphone Limited reserves the right to:

  • Monitor traffic and usage patterns
  • Investigate suspected violations
  • Request documentation (e.g., opt-in proof, call recordings)

We maintain active filtering systems, including Do-Not-Origin (DNO) list enforcement.

7. Suspension and Termination

We may suspend or terminate services immediately if:

  • This AUP is violated
  • Suspicious or non-compliant traffic is detected
  • Regulatory or carrier complaints are received

No prior notice is required in cases of serious violations.

8. Responsibility of Customers

Customers are responsible for:

  • Ensuring their end-users comply with this AUP

  • Using approved and compliant dialing systems
